{"id":3621,"date":"2021-04-01T23:04:43","date_gmt":"2021-04-02T05:04:43","guid":{"rendered":"http:\/\/accesstomexico.mx\/blog\/?p=3621"},"modified":"2021-04-01T23:04:43","modified_gmt":"2021-04-02T05:04:43","slug":"government-takes-another-step-toward-greater-control-of-energy-sector","status":"publish","type":"post","link":"https:\/\/accesstomexico.mx\/blog\/government-takes-another-step-toward-greater-control-of-energy-sector\/","title":{"rendered":"Government takes another step toward greater control of energy sector."},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"850\" height=\"530\" src=\"https:\/\/accesstomexico.mx\/blog\/wp-content\/uploads\/2021\/04\/ENERGY-ING-1.jpg\" alt=\"\" class=\"wp-image-3622\" srcset=\"https:\/\/accesstomexico.mx\/blog\/wp-content\/uploads\/2021\/04\/ENERGY-ING-1.jpg 850w, https:\/\/accesstomexico.mx\/blog\/wp-content\/uploads\/2021\/04\/ENERGY-ING-1-300x187.jpg 300w, https:\/\/accesstomexico.mx\/blog\/wp-content\/uploads\/2021\/04\/ENERGY-ING-1-768x479.jpg 768w, https:\/\/accesstomexico.mx\/blog\/wp-content\/uploads\/2021\/04\/ENERGY-ING-1-700x436.jpg 700w, https:\/\/accesstomexico.mx\/blog\/wp-content\/uploads\/2021\/04\/ENERGY-ING-1-520x324.jpg 520w, https:\/\/accesstomexico.mx\/blog\/wp-content\/uploads\/2021\/04\/ENERGY-ING-1-360x224.jpg 360w, https:\/\/accesstomexico.mx\/blog\/wp-content\/uploads\/2021\/04\/ENERGY-ING-1-250x156.jpg 250w, https:\/\/accesstomexico.mx\/blog\/wp-content\/uploads\/2021\/04\/ENERGY-ING-1-100x62.jpg 100w\" sizes=\"auto, (max-width: 850px) 100vw, 850px\" \/><\/figure>\n\n\n\n<p><a href=\"https:\/\/mexiconewsdaily.com\/news\/government-takes-another-step-toward-greater-control-of-energy-sector\/\" target=\"_blank\" rel=\"noreferrer noopener\">MEXICO NEWS DAILY<\/a><\/p>\n\n\n\n<p>The federal government is forging ahead with its plans to increase state control in Mexico\u2019s energy sector, which was opened up to private and foreign companies by a 2014 reform.<\/p>\n\n\n\n<p>President L\u00f3pez Obrador, a staunch energy nationalist and fierce critic of the reform, sent a proposal to Congress on Friday to alter the federal Hydrocarbons Law, which governs activities in the oil sector.<\/p>\n\n\n\n<p>With an argument based on safeguarding national security, energy security and the national economy, AMLO, as the president is commonly known, is proposing that the federal government have the authority to suspend permits granted to private companies that operate in any part of the oil industry chain including production, processing, storage, transportation, sales to the public, importation and exportation.<\/p>\n\n\n\n<p>All permits granted by the Energy Ministry (Sener) and the Energy Regulatory Commission (CRE) to private firms that operate in the Mexican oil sector would be subject to suspension in case of \u201cimminent danger to national security, energy security or the national economy,\u201d according to the initiative sent to Congress.<\/p>\n\n\n\n<p>It was unclear how \u201cimminent danger\u201d would be defined.<\/p>\n\n\n\n<p>The proposed reform, which would benefit the state-owned oil company Pemex, comes after the passing of legislation that gives power generated by the Federal Electricity Commission (CFE) priority on the national grid over that produced by private and renewable energy companies.<\/p>\n\n\n\n<p>However, the Electricity Industry Law, and the government\u2019s energy reliability policy which also favored the state-owned CFE, have both been struck down by courts after they were challenged by private companies that have invested heavily in Mexico since the 2014 energy reform took effect.<\/p>\n\n\n\n<p>The legal challenges haven\u2019t dissuaded L\u00f3pez Obrador from pursuing his quest to \u201crescue\u201d Pemex and the CFE from what he describes as years of neglect and give them greater control of the energy sector. Just last week, the president said he was&nbsp;prepared to send a bill to Congress to change the constitution&nbsp;if the new electricity law is deemed unconstitutional.<\/p>\n\n\n\n<p>While that law aims to bolster the CFE by relegating private firms in the power supply pecking order, the objective of the proposal to change the Hydrocarbons Law is to expropriate private oil sector interests, according to one energy expert.<\/p>\n\n\n\n<p>Gonzalo Monroy, a Mexico City-based energy analyst, said on Twitter that he had read and analyzed AMLO\u2019s proposal and reached the conclusion that the aim is expropriation.<\/p>\n\n\n\n<p>\u201cOnce and for all I\u2019ll put it on the table: THEY WANT TO EXPROPRIATE \u2013 direct expropriation \u2013 by taking the place of owners and operators \u2026 of everything related to fuels,\u201d he wrote.<\/p>\n\n\n\n<p>\u201cA detail: not just fuels but ALL hydrocarbons and ALL petrochemical products,\u201d Monroy said in a subsequent tweet.<\/p>\n\n\n\n<p>The Mexican Institute for Competitiveness (Imco), a think tank, was also critical of L\u00f3pez Obrador\u2019s proposal.<\/p>\n\n\n\n<p>\u201cIf it\u2019s approved, this initiative will have negative implications for competitiveness,\u201d Imco said on Twitter, noting that Sener and the CRE could suspend permits granted to private companies if they \u2013 \u201cin their judgement\u201d \u2013&nbsp; represent a danger to security or the economy.<\/p>\n\n\n\n<p>\u201c[AMLO\u2019s proposal] also says that Pemex could take over the administration and operation of installations of companies whose permits have been suspended and make use of their personnel, which would represent an act of direct expropriation,\u201d the think tank said.<\/p>\n\n\n\n<p>\u201c\u2026 This initiative is presented at a time at which national and foreign investors are questioning the energy policy decisions of the current administration within the framework of the recently approved reform to the Electricity Industry Law,\u201d Imco noted.<\/p>\n\n\n\n<p>The global consulting firm Kearney this week cited the government\u2019s energy sector measures as a major reason&nbsp;Mexico wasn\u2019t included on its 2021 index&nbsp;of the 25 most attractive countries in the world for foreign investors.<\/p>\n\n\n\n<p><strong>Mexico News Daily Staff.
